In regards to photography. Can anyone publish a photograph without the consent of the person who is in the ph?

Recently I viewed a book that had a photo of me in it. The author did not take the photo nor did the author ask my permission to publish the photo. Also, the photographer is deceased, but only for 2 yrs, and did not give permission.

In answering questions like this, it is important to recognize that the internet crosses international boundaries, and the laws that govern what is or is not acceptable may be quite different in different countries.

In the US, it is perfectly legal for a photographer to make a photograph of a person without that person’s consent provided that the situation is not one where the subject has an expectation of privacy. In other words, you can photograph anyone in a public place, but you can’t legally photograph through a bedroom window.

Having made the photograph, there are no laws that prohibit publication. However, if you publish the photograph, you may expose yourself to liability if you don’t have the consent of the subject and if the image implies something about the subject that is untrue. You may also be exposed to legal concerns if you get paid for the image and you have not reached some kind of agreement with the subject regarding commercial exploitation of that image.
